TERMS AND CONDITIONS
Section 1 – Families and Individual Clients
Purpose
PairED Pathways provides educational consultancy and learning support services designed to improve student engagement, inclusion, and academic progress. All recommendations are educational in nature and do not constitute medical, therapeutic, or psychological advice.
Scope of Services
Services may include:

Educational assessments, observations, and planning

Development of Individual Education Plans (IEPs), Behaviour or Regulation Plans, and Personalised Learning Plans

Consultation and collaboration with schools or allied health professionals (with consent)
-
Guidance for families navigating the education system
PairED Pathways may liaise with schools or other professionals only with written consent from parents/carers.
Fees & Payments

All services are invoiced directly to the client.

Full payment is required before services commence.

Invoices include GST (where applicable) and are payable via direct deposit or Xero.

PairED Pathways reserves the right to suspend or cancel services if payment is delayed.
Cancellations

A minimum of 48 hours’ notice is required for cancellations or rescheduling.

Late cancellations (within 48 hours) may incur the full session fee unless due to illness or emergency, at PairED Pathways’ discretion.
Confidentiality & Privacy

PairED Pathways maintains strict confidentiality and complies with the Privacy Act 1988 (Cth) and Victorian Child Safe Standards.

Personal and educational information is stored securely on Google Drive, accessible only to authorised staff.

Information will not be shared without written consent, unless required by law (e.g. mandatory reporting).

Clients consent to PairED Pathways keeping notes and records for service delivery and progress monitoring.
Professional Boundaries & Limitations

PairED Pathways provides educational advice only, not clinical, therapeutic, or diagnostic services.

We may recommend consultation with allied health or medical professionals when student needs exceed our scope.

Educational outcomes depend on multiple factors, including student context, school engagement, and implementation consistency.
Intellectual Property

All resources, reports, and materials created by PairED Pathways remain our intellectual property.
Clients may use these materials for personal or educational purposes only and may not reproduce, distribute, or commercialise them without written permission.
Liability

PairED Pathways provides services with due care and professionalism but does not guarantee specific outcomes.
We are not liable for indirect or consequential loss, and our total liability is limited to the value of services provided.
Dispute Resolution

If a concern arises, both parties agree to seek resolution in good faith.
Unresolved matters may proceed to mediation in Victoria under the Victorian Small Business Commission guidelines before legal action is considered.
Termination
-
Either party may terminate services with written notice.
Fees for completed services remain payable.
Section 2 – Schools and Educational Settings
Purpose
PairED Pathways partners with schools and early childhood services to deliver consultancy, planning, observation, and professional learning that support student inclusion and achievement.
Services
School-based services may include:

Classroom observations and student consultations

Staff collaboration meetings
-
Educational and inclusion planning support
-
Professional learning and workshops
All work is scheduled in consultation with leadership and aligns with school policies and procedures.
Costs & Invoicing

When services are privately funded by families, no cost is incurred by the school.

If a school independently engages PairED Pathways, the school will be invoiced directly.

Invoices must be paid before services commence. GST applies where relevant.
Responsibility of the School or Education Setting
Schools agree to:

Provide reasonable access to the school environment for agreed purposes.

Inform staff of scheduled observations or consultations.
-
Retain duty of care for students at all times.
-
Ensure relevant policies and site expectations are communicated to PairED Pathways staff.
Insurance & Compliance
PairED Pathways maintains:

Professional Indemnity Insurance ($2,000,000)
-
Public Liability Insurance ($10,000,000)
-
Cyber Liability Insurance ($250,000)

All staff hold current Working With Children Checks and comply with the Victorian Child Safe Standards, privacy laws, and NDIS Code of Conduct.
Confidentiality & Privacy
All student and school information is handled in accordance with privacy legislation.
Written parent/carer consent is obtained prior to any observation or data collection.
Intellectual Property
All reports, resources, and materials produced remain the intellectual property of PairED Pathways.
Schools may use these internally but may not reproduce, distribute, or share them externally without permission.
Termination
Either party may terminate services with 7 days’ written notice.
Work completed prior to termination remains payable in full.
Liability & Indemnity
PairED Pathways is not responsible for indirect or consequential losses.
Liability is capped at the total value of services provided.
Schools agree to indemnify PairED Pathways against claims arising from misuse or misapplication of recommendations.
Governing Law
These terms are governed by the laws of Victoria, Australia.
Disputes will first be resolved informally and, if necessary, proceed to mediation in Victoria before any court action.
